1. Eligibility

Renters must be at least 21 years old and possess a valid, unexpired driver’s license issued by a recognized authority. International renters must present a valid passport and, if required, an international driver’s permit.

All additional drivers must meet the same eligibility criteria and must be present during the rental process to sign the agreement. The primary renter assumes full responsibility for any actions taken by additional drivers.

2. Vehicle Availability

Darag Motors LLC strives to provide the reserved vehicle; however, availability is subject to supply and operational conditions.

If the selected vehicle is unavailable, we may offer a comparable alternative at the same rate. If no equivalent vehicle is available, renters can reschedule or receive a full refund.

3. Rental Duration and Extensions

• The minimum rental period is seven days. Shorter rentals may be considered at the company’s discretion and may incur additional fees.

• Extensions must be requested at least 24 hours before the scheduled return time for approval.

• Late returns without authorization will result in daily late fees.

• If a vehicle is not returned and no communication is made, it may be reported as stolen.

4. Vehicle Maintenance

Darag Motors LLC ensures all vehicles are well-maintained and in roadworthy condition before each rental.

• Renters must inspect and report any pre-existing damage before leaving the rental lot.

• Any issues arising during the rental period must be reported immediately. Failure to do so may result in liability for damages.

• Renters are responsible for basic upkeep, such as refueling, tire pressure maintenance, and cleanliness.

5. Prohibited Actions

The following are strictly prohibited and may result in termination of the rental agreement and additional fees:

a) Smoking Policy – Smoking (including cigarettes, cigars, vaping, or marijuana) inside the vehicle is prohibited. A $250 cleaning fee will be charged if evidence of smoking is found.

b) Restricted Uses – The vehicle may not be used for:

• Illegal activities (e.g., drug transport, smuggling).

• Off-road driving or unpaved terrains.

• Racing, reckless driving, or speed testing.

• Towing or pushing other objects or vehicles.

c) Vehicle Modifications – Renters may not modify, tamper with, or alter the vehicle in any way.

d) No Standing or Jumping – Standing or jumping on the vehicle is strictly prohibited.

e) Pets – Pets are not allowed unless pre-approved. Additional cleaning fees may apply.

6. Accidents and Damages

• In case of an accident, theft, or damage, renters must immediately notify Darag Motors LLC and submit an incident report.

• Renters are responsible for obtaining a police report, witness statements, and necessary documentation related to the incident.

• Renters are liable for any damage, loss, or theft of the vehicle unless covered by an insurance policy or optional damage waiver.

• Failure to report incidents may lead to legal action.

7. Payment

Darag Motors LLC offers flexible payment options with no credit card required. Accepted methods include:

• Cash

• Cash App

• Zelle

• Apple Pay

• Major credit cards (Visa, Mastercard, American Express, Discover)

• Debit cards

A security deposit may be required at the time of rental. Refunds will be processed after the vehicle’s return, provided no damages, violations, or outstanding balances exist.

8. Breach of Contract

Violation of these terms may result in:

• Immediate termination of the rental agreement.

• Loss of the security deposit.

• Additional fees for damages, late returns, or cleaning.

• Legal action to recover financial losses.

9. Governing Law & Dispute Resolution

• This agreement is governed by the laws of Edison, New Jersey.

• Disputes will be resolved through binding arbitration in accordance with local regulations.

• Renters waive their right to a jury trial and agree to arbitration.

10. Refund Policy

Our refund policy is transparent and fair:

• Full Refund – Cancellations 48+ hours before pickup qualify for a full refund.

• Partial Refund – Cancellations within 48 hours of pickup incur a one-day rental fee.

• No Refund – No refunds for:

  • Early returns or unused rental days.

  • Cancellations after the scheduled pickup time.

  • No-shows without prior notice.

11. Acknowledgment and Agreement

By renting a vehicle from Darag Motors LLC, you acknowledge that you have read, understood, and agreed to these terms.

Failure to comply may result in financial penalties, legal action, or restriction from future rentals.
